| Notice of Public Sale
WHEREAS, the Yorktown Heights Fire District ("YHFD") owns and is in possession of one (1) Fire Apparatus, commonly known as a fire truck and specifically identified below, which has been determined by the Board of Fire Commissioner of the YHFD to be no longer necessary for any of the District's uses or purposes and
WHEREAS, the Board of Fire Commissioners believes it to be in the best interests of the YHFD to dispose of said equipment and receive for the benefit of the District the fair and reasonable value thereof, now therefore it is
RESOLVED that the Board of Fire Commissioners of the YHFD is hereby authorized to sell at public auction to the highest bidder, subject to the conditions and terms of bidding and sale as outlined below, one 1990 International Rescue Truck which may be examined by appointment only (914-962-5561): that open bids be submitted in writing to the Secretary/Treasurer of the YHFD, 1924 Commerce Street, Yorktown Heights, N.Y., no later than 4:00 pm on December 15th, 2009; that the bid be at a minimum of $40,000; that those who have timely submitted written bids may increase their respective bids at the date, time and place of the public sale; that the purchaser shall execute a Bill of Sale prepared by the YHFD Attorney; that the YHFD reserves to itself the right to reject all bids; that the payment of one hundred percent of the accepted bid be by cash and/or certified check within forty-eight (48) hours of acceptance of the offer; that the purchaser shall take delivery at a site designated by the YHFD within the YHFD; and that the sale of this used equipment by the YHFD, which is not a dealer in goods of this kind, shall be without warranties of any kind, express or implied, and that the sale shall be in the equipment's "as is" condition at the time of the public sale which shall be December 15th, 2009 at 6:30 p.m. at the YHFD sub-station located on Locksley Road, Yorktown Heights, New York.
All the above is pursuant to a Resolution of the Board of Fire Commissioner of the Yorktown Heights Fire District made and entered on the 10th day of November 2009, at a regular meeting of the said Board of Fire Commissioners.
